Terms of Use for “Namine Ritsu” Vocal Assets for Singing Synthesis Software

This agreement is between the audio recording provider Canon (hereinafter referred to as “Canon”) and the final end-users (hereinafter referred to as “the User”), establishing the terms of use for the “Namine Ritsu” vocal libraries (hereinafter referred to as “the Libraries”).

Article 1: Disclaimer of Warranty

  1. Canon provides absolutely no guarantee to the accuracy of the Libraries distributed on the website, contents of the text, etc. Additionally, Canon shall not be liable for any direct or indirect damages arising from the use of the Libraries by end users.
  2. Canon does not guarantee that the data provided on the website is free from viruses or other harmful contents, has not been accessed by any unauthorized third party, or that the website is secure.

Article 2: Redistribution of data is NOT banned

  1. The copyright of the audio files in the Libraries belongs to Canon. With the exception of any situation ruled as unusual circumstances, Canon forbids the User from redistributing the Libraries through any other website, magazine, advertisement, or similar. However, the User may redistribute the Libraries upon receiving approval from Canon… or so I thought, but I don’t really care about redistribution. Deleting this section is a bother but I’ll fix it someday

Article 3: Attribution of Rights

  1. All rights to the Libraries belong to Canon, and as such the User must not perform any act in violation of the same rights.
  2. Canon shall not bear any responsibility for expenses incurred to the User in the event of a dispute arising from violating the terms of this agreement, or in resolving the dispute through the appropriate authorities.

Article 4: Damage Compensation

  1. Should the User cause damages or loss to Canon when violating the terms of this agreement, the User is responsible for any compensation as determined by the appropriate authorities, and Canon shall not be held responsible.
  2. Canon is entitled to all compensation for damage or loss suffered as a result of the User violating Article 3.

Article 5: Temporary pause or end of distribution of the Libraries

  1. At any time, Canon may temporarily pause or end distribution of the Libraries without prior notice to the User.
  2. Canon holds no responsibility for any direct or indirect loss or damage suffered by the User or any third party as a result of the temporary pause or end of distribution of the Libraries.

Article 6: Permitted Usage

  1. Canon grants the User a non-exclusive license for commercial and noncommercial use of the Libraries without any licensing fee.
  2. Modification and alteration of data within the scope of personal use is not a problem as long as it is not distributed.
  3. Any use of the Libraries which may constitute a criminal offense will require additional usage approval in advance. This will be reported to authorities.

Article 7: Jurisdiction of Agreement

  1. In the event of any uncertainty arising from this agreement, Canon may make a decision on the interpretation to a reasonable extent.
  2. All disputes between Canon and the User shall be settled exclusively in the first hearing at the Asahikawa District Court.
  3. This agreement is governed by the laws of Japan.

Article 8: Other

  1. As circumstances arise, Canon may revise these terms as needed without any prior notice.
  2. If any works produced using the Libraries are deemed inappropriate by Canon, the user should comply with requests to unpublish or delete the work.
